The article provides an update on how consumers are protected by codes of practice and shares five actions property practitioners should complete, whether acting for consumers or developers in the sale and purchase of new homes. What is the code?
The Code provides a clear consumer complaints process supported by an independent Dispute Resolution Scheme for consumer complaints that arise and are made in writing to the Developer within two years of the date of the Completion of the New Home purchase. Requires the developer to provide all relevant information about the home during the sales process– including its tenure and any future management or service charges – that allows them to make an informed decision about their purchase. CEDR will adjudicate the dispute and an independent adjudicator will issue a final decision. Please note that maximum award that can be claimed under this scheme is capped at £50,000 .

Where a developer is found to be in serious breach of the Code, the Code Sponsor can apply a range of sanctions, including removal from the Code’s register of members. This will also result in removal from the registers maintained by the Warranty Bodies who support the Code. The Code provides an independent dispute resolution scheme for complaints that arise and are made in writing to the developer within two years of the date of the completion of the new home purchase. The Code also benefits second and subsequent buyers of the new home but only in respect of after sales matters reported within two years of the date of the completion of the new home purchase. Nothing contained within this Code affects a buyer’s existing legal rights and does not replace any existing legislation regarding the sale and marketing of new homes to consumers.
New Homes Quality Code published
This limit is applied to the cumulative total claimed and consumers must claim for all areas of any existing dispute/s with the developer at one time, where possible. The scheme is independent of the developer and the warranty bodies and any matter referred to this scheme concerns disputes under the Consumer Code for New Homes only. The adjudication will be independent and conducted by a trained independent adjudicator who must be a member of CEDR. The scheme is applicable to complaints made within the first two years from completion of the New Home, in the event that a dispute arises between the buyer and the developer where agreement cannot be reached within 56 calendar days of the complaint being raised with the developer.

Purchasing a New Home is a significant expense for most consumers and there are many different factors which purchasers consider including location, design and suitability as well as price and reputation of the Developer. “It fills the gaps in existing protections and puts considerably more requirements on builders in terms of how they deal with their customers and any issues that they have with their new home. The New Homes Quality Board has today published its New Homes Quality Code – thenew code of practicefor the house building industry that aims to drive up the quality of new build homes and strengthen protections for customers. If your complaint is not resolved to your satisfaction by the developer you may submit an application to CEDR for adjudication. However, you will need to contact CCNH first to confirm your home is covered by the Code and confirm the area of complaint is within scope of the Code. CCNH will also check to see if you have followed the Code’s complaints process ahead of you making an application to CEDR.
